Although not as highly publicized, elder attorneys are important legal counsel professionals that are needed to help support the legal needs of a growing population. An elder attorney provides representation to those that are of an elderly age. Although there is typically no start age limit of those that are eligible to hire an elder attorney, there are usually certain issues that are exclusively dealt with by such an attorney. One legal matter is disability. When a person reaches a certain age, there are usually legal issues that have to be adhered to in terms of disability. One of the most common matters is that an elderly client wants to ensure that they are receiving his or her disability check on a periodic, but consistent basis. They also want to be sure that they are receiving the disability check in the proper amount that is due and expected. In order to reach that goal, some have the need to hire an elder attorney to assist them in facilitating this action. They will usually hire elder attorneys to help them obtain, complete, and submit all necessary paperwork so that this may come into fruition. They will also be looking to the elder attorney to make sure that they remain on task with any follow-up responses or correspondence on the matter of their disability. With that, they will sometimes need the professional discipline of elder attorneys to translate the instructions, letters, and documents that they need throughout the course of the process.

Elder Attorney are hired by those that are having issues with receiving their Medicaid. Medicaid is a state and federal government health care program for qualified applicants. The qualifications that are typically to be met is that the eligible individual be a child of low income or with limited resources, is a senior that needs financial assistance with their health care, or is an individual that has a certain qualifying disability. Many of the patients that are eligible for Medicaid and hire elder attorneys to handle this legal matter are a large population of those that currently reside in nursing homes. There are also Medicare issues that they need to have addressed with the help of an elder attorney. Oftentimes, the elder attorney will help to facilitate the request the right government agency so that their medical bills will be either fully compensated, or partly accounted for. In addition, those that reach retirement age will often hire an elder attorney just before or just after they retire.

It is also very common that an elderly person will hire an elder attorney to assist with his or her estate planning. Once the elderly reach a certain age, they tend to have a heightened concern for what it is that they are going to leave behind. They want to ensure that they are going to be able to leave behind as favorable a legacy as possible. This often constitutes in adhering for the proper estate planning at an old age, and after their time of passing. Elder attorneys will help this individual make the proper arrangements when he or she has the capacity to do so. The elder attorney will also take this opportunity to assist the elderly person with paying and settling any and all debts that he or she has, so that little, if any, are left behind to his or her loved ones. An important part of the legal counsel for estate planning will be the drafting of the will. Even if there was a will that was already drafted earlier on, there are often a number of revisions that need to be made, as a person embarks upon the closing chapter of his or her life.

Some of those issues may include facilitating their monthly rent payments or mortgage payments, facilitating the payment of their household utilities, paying storage fees, or any other property payments they have. Such responsibilities may include managing the upkeep of their properties, including the aesthetic look and feel, as well as any improvements or maintenance issues that need to be addressed.

Elder attorneys are hired frequently by the elder or the family member of an elder in order to handle a matter of elder abuse. Elder abuse is one of the common occurrences that are bound to happen to an individual that is of an elderly age. Elder abuse is the act of preying on an individual by violating their expectation of trust, simply because they are members of the elder community. This may come at the hands of an individual that the elderly person does not know, or it can be a violation from someone that they have very close ties with, such as a family member. Elder abuse is not limited to verbal trickery, violence targeted at the elderly, also constitutes as a common form of elder abuse. Since there are an increased number of instances of elder abuse cases that have transpired, the International Network For Prevention of Elder Abuse has come to designated June 15 as the day in which international awareness is spread about the issue. June 15 is intended to be a way in which people can pitch in and help, as well as ways that the elderly may be more vigilant and mindful of potential scams and other forms of elder abuse.

Elder attorneys that handle elder abuse will have clients that are or are not of huge support to the elder abuse that they have experienced. Since elder abuse can pose such a dramatic, long-lasting threat to those that fall victim to it, it is not at all unlikely that he or she is unable to actively support their claims in the way in which is most helpful to the case. It is found that even though they may be presented with this legal issue, it is not everyday that the elderly tend to take the legal issue all the way to court. Oftentimes, they will speak to a family member or friend about a rights elder abuse legal issue that they are facing, and that is how they discover that their constitutional or civil rights have not been properly recognized. From there, if that family member or friend does not initiate the legal matter, it is rare that the elderly will go the full extent of pursuing the legal matter himself or herself.

One of the largest scams that happen to those that are elderly is some form of financial credit abuse. There are a number of financial companies that prey upon the elderly in order to get them to agree to unnecessary financing. The elder attorney is there to persecute these matters. A typical scenario of this type of elder abuse is that a representative from a financial will call an elderly person who has a credit card debt that they are currently outstanding with. The representative will tell the elderly person that the company will help them with that debt if they agree to sign up with that company. One of the aspects of signing with the company that they will quickly go through with the elderly and get them to agree to, is the fact that there is a charge associated with signing with this company. Many elderly victims come to find that they have been billed to pay a large fee to that company, but they will also find that the outstanding debt that they have has not been addressed at all. Once the elderly realizes this and calls the company back, they are usually reluctant to remove the charge because they feel that since they were able to outwit the elderly person to begin with, they will not be able to present a valid argument to the new representative that they are speaking with, and more than likely they do not have the mental capacity or the financial means to combat the issue. Well, there are some instances in which an elder attorney is hired to address the issue.
